Rental terms and conditions

This document provides the procedures to follow when booking facilities on the website www.divineamalfi.it and the contractual conditions for the management of relationships between the customer and Divine Amalfi Company of Cristina Diambra (henceforth Divine Amalfi).
1) Property for rent
All properties listed on the site www.divineamalfi.it are suitable for tourist rental and are furnished and equipped to accommodate the number of persons indicated in the description of each property. Divine Amalfi acts as an intermediary between the tenant (customer or Vacationer) and the owner and its obligations to the customer are intended solely in this context.
2) Requests for information and availability
The customer can send a request regarding availability, or information relating to one or more properties, using the appropriate form published on the website www.divineamalfi.it, or directly via email at info@divineamalfi.it. After verification, Divine Amalfi will send a written notification with confirmation of availability and price and all the necessary information.
3) Prices
The prices are published in the daily, or weekly, price list accompanying the description of each property. They are based on market conditions and denominated in Euro. Divine Amalfi reserves the right to change the listed prices in the case of exchange rate fluctuations of more than 5%. This rule also applies to the payment of the balance.
4) Pictures and descriptions
The images and descriptions published on the website of Divine Amalfi respond to the real conditions of the property at the time of our agent's inspection. If the owners were to make substantial changes to the property, they are obliged to immediately inform in Divine Amalfi to allow the immediate update of the published data. Divine Amalfi is not responsible for the non-observance of these obligations by the owner.
5) Booking and payment terms
Down payment: for each customer who sends a reservation request , a 5-7 day option period will be opened in which to send payment to confirm the reservation request. To confirm a reservation you must send a deposit of 30% of the total amount of the rent (and other additional costs), to be paid by bank transfer to Divine Amalfi. To hold the property, the customer must send by fax or email the bank receipt certifying the payment of the transfer together with the contract signed in all its parts. Booking will be valid when the down payment is credited to the bank account of Divine Amalfi, who will send written notice to the tenant, along with all the information regarding the lease conditions and the house rules of the property. Balance: The balance must be paid no later than 40 days before the arrival date at the property rented. If payment is not received within that time, the booking is subject to cancellation without notice. For bookings made less than 40 days before arrival, the rental price must be paid in total.
6) Acceptance of terms of rental
The deposit paid by the tenant and the acceptance of Divine Amalfi involves both the tenant and Divine Amalfi in the tacit acceptance and the obligation to comply with the general terms and conditions of lease listed herein . The specific conditions of rental vary from property to property and are specified in the document that Divine Amalfi will send the customer on confirmation of booking.
7) Minimum rental period
The minimum rental period varies depending on the type of property and is indicated in the description of the structure. Generally for luxury villas it is one week and for apartments three days, but it can vary depending on the season and whether the facilities are rented for events, or for yoga retreats.
8) Arrival and Departure
The arrival time is scheduled at 3-7 PM unless otherwise agreed in writing. The departure time is from 8.00 AM until 10.00 AM. Every time change must be agreed and confirmed by Divine Amalfi at least 48 hours before arrival. In the case of late arrival, the customer must notify the owner, or the key-holder, by calling the number provided in the booking voucher. Divine Amalfi disclaims any liability and no refund will be given if the tenant cannot enter the residence on the day, or at the hour, planned due to travel delays. The same rule also applies to early departures.
9) Entrance to the property
Upon receipt of the portion of the balance, Divine Amalfi will send the tenant a document (Rental Confirmation) containing all the information relating to the property: address, directions to get there, how to contact the owner / manager or person in charge of the keys and all costs to be paid on-site. This document must be provided upon arrival to the owner / manager or the key-holder along with the passport, or identity document, of all occupants of the rental property, as required by Italian law.
10) Security deposit for damages
On arrival, the client will have to pay in cash the guarantee required in case of damage to property, as shown in the confirmation of the rent. This amount will be returned to the tenant at the end of the stay, less any deduction for damage to the property, or extra charges not included in the rental cost. The owners, or their representatives, may refuse entry to vacationers if the deposit is not made. Any extra costs to be paid locally, indicated in the document of lease, are considered an integral part of the accepted lease.
11) Extra costs
The extra costs that relate to additional services available at a property are indicated in the relative description. The customer may request this before arrival (recommended), or during their stay they may request it from the owner, or their representative. If the customer wishes to receive services that a facility does not provide, the request must be made when booking and Divine Amalfi will provide the best solution to suit the client's budget.
12) Number of persons - replacements - use of the structure
The number of people staying in a structure (adults and children) must not exceed the number stated in the information of the property, except in the case of children under 2 years of age. Any replacement of the guests during the rental period is forbidden unless previously agreed. The spaces of the property must not be used for receptions, parties, or events in general, without specifically granted permission given by the owner or their representative. External service providers, cooks, waiters, bartenders, caterers, live performer, massage therapists can provide their services at the property only if expressly authorized. Guests who do not sleep in the structure cannot participate in any party, dinner party organized in the premises of the property without asking permission. The owner may refuse such permission, or request that a maximum number of guests is not exceeded. Exceptions to the above are to be agreed before completing the booking process, clients are, therefore, recommended to express their intentions before booking.
13) Weddings and Events
Most of the structures published by Divine Amalfi are suitable to host events; the maximum number of persons is indicated in the description of the structures and the related section Wedding Locations. Divine Amalfi has the best consultants and wedding planners in the area to support the client in the organization of the event, ensuring that it is a success. For events and / or ceremonies in its structure, the owners may request a venue fee in addition to the basic cost of the rental. They can also request that suppliers of services for such events are their trusted people, in order to avoid damage to their property. Some facilities include a private chapel, or are located near a Catholic church. If the client desires to celebrate a ceremony in one of these churches, they must specify it at time of booking in order to secure the date in question and initiate a request to perform the function.
14) Cancellation by the tenant
In case of cancellation of a reservation by the tenant, they will be entitled to a refund of rent subject to the deduction of a penalty, as described in the Terms of Cancellation given in the booking documents provided before payment of the first instalment.
15) Cancellation by Divine Amalfi
Although it is unlikely that Divine Amalfi will have to make any change to confirmed bookings, it does occasionally happen, in which case Divine Amalfi will advise the tenant at the earliest possible date. a) If for any unforeseen reason Divine Amalfi is unable to provide the tenant with the already booked property, Divine Amalfi will offer the tenant an alternative property of comparable standard. However, if this is not possible or the tenant does not wish to be transferred, Divine Amalfi will cancel the booking and refund the amount paid to Divine Amalfi for the property. b) In the event of force majeure, Divine Amalfi reserves the right to annul the contract and return the amount paid. c) In the case of extra services not included in the rental price (i.e. cook, cleaning services etc) Divine Amalfi cannot be held responsible for any eventual variations in the prices and/or utilization procedures which take place after the confirmation.
16) Responsibility
Divine Amalfi is not responsible for any physical damage caused to holidaymakers during their stay at the property. It therefore recommends customers to take out travel insurance against accidents before their departure. In the case of problems occurring during the stay the holidaymaker undertakes to do their utmost to solve them in the best way possible, without creating consequences. In the event that the holiday maker cannot solve the problem, they must immediately notify the owner / manager or key-holder. If they are not able to solve the problem, the lessee must immediately inform the offices of Divine Amalfi by phone (+39 3473484622) or by email (info@divineamalfi.it). This will allow Divine Amalfi to solve the problem during the stay. The client is required to give the time necessary to resolve the issue. Anyone who leaves the holiday home prematurely and without warning, without giving the Divine Amalfi the opportunity to resolve problems, lose all rights to a refund. In the unfortunate event that the problem can- not be resolved during the stay and the tenant wants to resolve the issue with Divine Amalfi after their return, they must send a letter within ten days from the date of their return. No claims will be accepted that are not submitted during the period of stay as mentioned above. If for unforeseeable, insurmountable circumstances it is not possible to stay in a structure, Divine Amalfi will place the customer in another structure which has similar characteristics. If the customer accepts the replacement and the structure should has the same price as the initial one, nothing is owed by the Client to Divine Amalfi. If the new structure should have a higher price, the customer must pay the difference in rent to Divine Amalfi.
17) External Maintenance:
The owners, or their representative, reserve the right to have access to outside areas of the property to carry out the ordinary maintenance services (swimming pool, garden, etc.).
18)Final cleaning
Even though tenants are obliged to pay for on-site final cleaning, they are obliged to leave the property in a clean and tidy condition, otherwise they could incur additional costs beyond those already owed.
19)Heating
In general, the heating can be used from November to April, as governed by current Italian legislation.
20) Privacy
In accordance with paragraph 13, law L. 196/03 on the protection of privacy and personal data, Divine Amalfi director Cristina Diambra, with headquarters in Via Capella 6,Amalfi, declares that the personal information of the lessee are to be used for reasons related to, or necessary for, the completion of our business, i.e.: a) entering into leases, through booking procedure; the conduct and the proper execution of the various contractual obligations; management and resolution of disputes; b) Information on the marketing of our catalogues; sending catalogues; measurements of the degree of customer satisfaction of Divine Amalfi. c) The provision of data is necessary for the fulfilment of contractual obligations, for the relevant administrative and fiscal obligations. d) Consequences: refusal to give consent to the processing of data with regard to point a) will result in Divine Amalfi being unable to perform its functions in the contract. As regards point b) above, concerning the refusal to allow the processing of personal data, to this end will not have any negative effect. e) How: the data processing will be carried out with the help of modern computing equipment used by employees. The data will not be communicated or disclosed to third parties, except when required by the obligations of the contract or the law. f) Rights: the client may exercise the rights provided by 'art. 7 of Law 196/2003, on request, by the person responsible for processing the data, which is the current director.
21)Jurisdiction
In the event of any disputes that may arise, the competent authority is that of the Court of Salerno and the only law applicable is Italian.
